The Kentucky Court of Appeals has issued an opinion expanding the time to appeal from a trial court order re-opening a final judgment or order. Hill v. Bryant, 2015-CA-1290. In Hill, the Court held that a litigant harmed by a trial court’s order re-opening a judgment pursuant to Kentucky Rule of Civil Procedure 60.02 does not have to appeal within 30 days of the order. Rather, such a litigant can choose to either immediately appeal the order granting CR 60.02 relief or wait until the conclusion of the re-opened proceedings and challenge the CR 60.02 order on appeal then.
